Introduction and Acceptance Welcome to the Tamkār application ("the App" or "the Service"), a platform for managing Instagram business accounts that enables automated replies to Instagram direct messages using artificial intelligence. These Terms of Use ("the Terms") constitute a legally binding agreement between you ("the User" or "you") and us. By using the App, creating an account, or connecting an Instagram account, you acknowledge that you have read these Terms and fully agree to them and to the associated Privacy Policy. If you do not agree to any provision, please do not use the App. 2. Definitions "the App" / "the Service": The Tamkār platform and all related interfaces, dashboard, and services. "the User" / "you": The individual or business entity that creates an account or uses the App. "Meta Platform": The services and APIs of Meta Platforms, Inc., including the Instagram Graph API. "Meta Data": The data we access through the Meta Platform under your explicit permission. "AI": Google's Gemini model used to generate automated replies. 3. Description of the Service The App provides the following features: Connecting an Instagram business account via Meta's official login (OAuth 2.0). Receiving incoming Instagram direct messages from your customers and replying to them automatically using AI. Managing products, orders, and conversations and displaying reports within a dashboard. We may add, modify, or discontinue any feature at any time as required by the development of the Service. 4. Eligibility To use the App, you must be an adult (18 years or older) with the legal capacity to enter into contracts, and you must use the App for lawful business purposes. By using the App, you confirm that you meet these requirements. 5. Account and Security You are responsible for the accuracy of the information you provide upon registration. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs through your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate any account that violates these Terms. 6. Connecting Your Instagram Account and Compliance with Meta Policies When you connect your Instagram account, you grant us — through Meta's official OAuth protocol — specific permissions (instagram_business_basic and instagram_business_manage_messages) solely to provide the stated service. You confirm that you are the owner of, or legally authorized to manage, the connected Instagram account. You undertake to use the App in accordance with the Meta Platform Terms, the Instagram Platform Policy, and the Instagram Community Guidelines. You may withdraw permissions and disconnect at any time from the App settings or from your Instagram settings, after which we delete the Meta Data associated with you in accordance with the Privacy Policy. Tamkār is an independent application and is not affiliated with, endorsed by, or sponsored by Meta or Instagram; all trademarks belong to their respective owners. 7. Acceptable Use Policy You agree not to use the App for any of the following: Sending spam, fraudulent, misleading, or unwanted content. Violating any applicable law, the rights of others, or Meta/Instagram policies. Posting or promoting illegal, abusive, hateful, or violent content, or content that infringes intellectual property. Attempting to hack, disrupt, or gain unauthorized access to the App, its systems, or other users' data. Using the App to collect, resell, or use Meta Data outside the scope of the Service. Automating behavior that violates Meta's messaging limits and rules (such as unlawful bulk sending). Any violation that could expose your account — and the App's account with Meta — to suspension. 8. AI-Generated Content The App uses the Gemini model to generate suggested replies to your customers' messages. You acknowledge the following: Automated replies may contain errors or inaccurate information, and we do not guarantee their accuracy or suitability for every case. You are primarily responsible for the content sent from your account, and you may enable manual review mode to review replies before they are sent. You are responsible for ensuring that replies comply with Meta's policies and applicable laws. Directing the AI to produce misleading, harmful, or policy-violating content is prohibited. 9. Intellectual Property All intellectual property rights in the App (software, designs, trademark) are owned by us or our licensors. The content you enter (your products and data) remains owned by you, and you grant us a limited license to process it solely for the purpose of providing the Service. 10. Third-Party Services The App relies on third-party services, including: the Meta Platform (Instagram Graph API), Google Gemini for AI, and Google Cloud for hosting. Your use of these services is subject to their own terms. We are not responsible for any malfunction, change, or interruption in third-party services beyond our control. 11. Fees and Subscription Some App features may be free and others paid via subscription. We will disclose any fees before they are activated, and we do not charge any amounts without your consent. Paid fees are non-refundable except to the extent required by law or as we expressly decide. 12. Privacy and Data Protection Our processing of your data and Meta Data is governed by the Privacy Policy published at https://app.tamkar.online/privacy, which is an integral part of these Terms. By using the App, you agree to that policy. 13. Service Availability and Modifications We strive to make the Service continuously available, but we do not guarantee that it will be free of interruptions or errors. We reserve the right to modify, suspend, or discontinue the Service in whole or in part, notifying you of any material change where possible. 14. Disclaimer of Warranties The App is provided "as is" and "as available" without any express or implied warranties, including warranties of fitness for a particular purpose, uninterrupted operation, or freedom from errors, to the maximum extent permitted by law. 15. Limitation of Liability To the maximum extent permitted by law, we are not liable for any indirect, consequential, or incidental damages (such as loss of profits, data, or business opportunities) arising from your use of, or inability to use, the App, or from AI-generated content, or from third-party services. 16. Indemnification You agree to indemnify, defend, and hold us harmless against any claims, losses, or expenses (including legal fees) arising from your violation of these Terms, Meta's policies, or applicable laws, or from the content you send through the App. 17. Suspension and Termination We reserve the right to suspend or terminate your access to the App immediately upon violation of these Terms, Meta's policies, or for legal requirements. You may terminate your use at any time by deleting your account. Upon termination, we delete your data and the Meta Data associated with you in accordance with the Privacy Policy and the retention schedules stated therein. 18. Changes to the Terms We may update these Terms from time to time. In the event of any material change, we will notify you through the App or by email before it takes effect. Your continued use of the App after the changes take effect constitutes acceptance of them. 19. Governing Law and Dispute Resolution These Terms are governed by and construed in accordance with the laws of the Republic of Iraq. In the event of any dispute, we first seek an amicable settlement, and if it cannot be reached within 60 days, the dispute is referred to the competent authorities under the laws in force in the Republic of Iraq. 20.
